I understand this perfectly, so I’m putting in your hands a document in which you will find in one place the rules for the processing of personal data and the use of cookies and other tracking technologies in connection with the website https://metalsradar.com/.

Metalsradar.com is a free website that compares prices of precious-metal bullion (coins and bars) offered by dealers in several markets. I do not sell anything on this website: there is no online store, no orders, no shopping cart and no user accounts. When you click a “Go to shop” link, you leave my website and go to the website of an external dealer, which processes your data under its own privacy policy.

This privacy policy is structured in the form of questions and answers. The choice of this form was dictated by the concern for clarity and readability of the information presented to you. Below you will find a table of contents of this policy corresponding to the questions I answer in turn.

Who is the controller of your personal data?

Who can you contact about your personal data?

What information do I process about you?

Where do I get your personal data from?

Is your data secure?

For what purposes and on what legal basis do I process your personal data?

How long do I keep your personal data?

Who are the recipients of your personal data?

Do I transfer your data outside the European Economic Area?

Do I use profiling or automated decision-making?

What rights do you have in relation to your personal data?

Do I use cookies and what are they?

On what basis do I use cookies?

Can you disable cookies?

For what purposes do I use my own cookies?

What third-party cookies are used?

Do I track your behaviour on my website?

How can you manage your privacy?

What are server logs?

Is there anything else you should know?

Can this privacy policy change?

If you have any concerns about the privacy policy, you can contact me at any time by sending an email to contact@metalsradar.com.

1. Who is the controller of your personal data?

The controller of your personal data is Metalsradar.com, al. Jana Pawła II 27, 00-867 Warszawa, Poland, e-mail: contact@metalsradar.com.

2. Who can you contact about your personal data?

I have not appointed a Data Protection Officer, because it is not mandatory in my situation. For all matters related to data protection and privacy, you can contact me at contact@metalsradar.com.

3. What information do I process about you?

Depending on how you use the website, I may process the following information about you:

e-mail address,

the price threshold you set for a price alert (optional) and the market (country) you subscribe for,

the date of your consent and its confirmation (double opt-in),

statistics related to the e-mails you receive from me (e.g. whether a message was opened or a link was clicked),

data contained in e-mail correspondence with me,

IP address.

Moreover, I use tools that collect information related to your use of the website. This includes, in particular:

information about your operating system, web browser and device type,

pages viewed and time spent on the website,

transitions between individual pages,

clicks on “Go to shop” links leading to dealer websites,

the source from which you came to the website (including UTM parameters in the link),

your approximate location limited to the country or city.

This information is referred to hereafter in this privacy policy as “Anonymous Information”.

On its own, this information does not allow me to identify you, and I do not combine it with the personal data I hold about you. As a precaution, in case such information were treated as personal data, this policy explains how it is processed.

4. Where do I get your personal data from?

In most cases, you provide it yourself. This happens when:

you sign up for the newsletter,

you set up a price alert,

you contact me by e-mail.

In addition, some information about you may be collected automatically:

the server hosting the website and the mailing system record your IP address,

the mailing system records your activity in relation to the e-mails sent to you, such as opening messages or clicking on links,

the website counts clicks on “Go to shop” links,

Google Analytics and Jetpack collect Anonymous Information related to your activity on the website (Google Analytics only if you consent to analytics cookies).

5. Is your data secure?

I care about the security of your personal data. I have analysed the risks involved in processing your data and have implemented appropriate security measures. I use reputable service providers, monitor the state of the technical infrastructure and make the necessary improvements. If you have any questions about your personal data, I am at your disposal at contact@metalsradar.com.

6. For what purposes and on what legal basis do I process your personal data?

The purposes, together with the legal basis under the General Data Protection Regulation (GDPR) assigned to each of them, are:

sending the newsletter – Article 6(1)(a) GDPR (consent),

sending price alerts – Article 6(1)(a) GDPR (consent),

analysing how subscribers react to e-mails – Article 6(1)(f) GDPR (legitimate interest),

handling correspondence – Article 6(1)(f) GDPR (legitimate interest),

counting clicks on links to dealer websites – Article 6(1)(f) GDPR (legitimate interest),

website analytics with Google Analytics – Article 6(1)(a) GDPR (consent given in the cookie banner),

website statistics and security with Jetpack – Article 6(1)(f) GDPR (legitimate interest),

storing your cookie consent choice – Article 6(1)(f) GDPR (legitimate interest in respecting and being able to demonstrate your choice),

keeping an archive for the possible need to establish, assert or defend claims – Article 6(1)(f) GDPR (legitimate interest).

Newsletter – details

To subscribe to the newsletter using the form in the footer of the website, you provide your e-mail address and give your consent. Providing the data is voluntary, but necessary to receive the newsletter. After signing up, you will receive an e-mail asking you to confirm your subscription (double opt-in). Your subscription becomes active only after you confirm it.

The mailing system I use (MailerLite) records the IP address you used when signing up, and tracks your actions taken in connection with the messages sent to you, such as which messages you opened and which links you clicked. Subscribers are kept in separate groups for each market (country).

The legal basis for sending the newsletter is your consent (Article 6(1)(a) GDPR). You can withdraw it at any time by clicking the unsubscribe link included in each message or by contacting me. Withdrawing consent does not affect the lawfulness of processing carried out before the withdrawal. As for the information collected automatically by the mailing system, I rely on my legitimate interest (Article 6(1)(f) GDPR) in analysing how subscribers react to messages in order to improve them.

Price alerts – details

You can ask to be notified by e-mail about prices of precious metals. To set up a price alert, you provide your e-mail address and, optionally, a price threshold, and give your consent. As with the newsletter, you have to confirm your subscription by clicking the link in a confirmation e-mail (double opt-in). Price alerts are sent through MailerLite, and alert subscribers are kept in separate groups for each market (country).

The legal basis for sending price alerts is your consent (Article 6(1)(a) GDPR). You can withdraw it at any time by clicking the unsubscribe link included in each alert or by contacting me.

After you unsubscribe from the newsletter or price alerts, your e-mail address may still be kept in the mailing system, marked as unsubscribed, in order to prove that you gave and withdrew your consent and when. This is my legitimate interest (Article 6(1)(f) GDPR).

Handling of correspondence – details

When you contact me by e-mail, you provide the personal data contained in the correspondence, in particular your e-mail address and name. Providing the data is voluntary, but necessary to reply to you. I use Google Workspace to handle e-mail sent to contact@metalsradar.com.

Your data is processed in order to reply to you, which is my legitimate interest (Article 6(1)(f) GDPR). After the contact ends, correspondence may be archived so that I can prove certain facts in the future, which is also my legitimate interest (Article 6(1)(f) GDPR). You may request the history of our correspondence and its deletion, unless keeping it is justified by overriding interests, such as defence against possible claims.

Clicks on links to dealer websites – details

The website does not sell anything. When you click a “Go to shop” link, the click is counted before you are redirected to the dealer’s website. Only the following information is recorded: which dealer and product the link concerns, the market, the page on which you clicked the link, your device type and UTM parameters, if present. I use these anonymous statistics to measure how much traffic my website sends to dealers. This is my legitimate interest (Article 6(1)(f) GDPR).

Analytics and statistics – details

I analyse traffic on the website using Google Analytics and Jetpack, described in detail later in this privacy policy. Within these tools, I only have access to Anonymous Information and aggregated statistics, not attributed to specific individuals. For this reason, I am not able to provide you with access to Anonymous Information about you.

Google Analytics is used only if you consent to analytics cookies in the cookie banner (Article 6(1)(a) GDPR). You can withdraw your consent at any time by changing your cookie settings on the website. Jetpack statistics and security features are based on my legitimate interest (Article 6(1)(f) GDPR) in knowing how the website is used and protecting it against attacks.

Archive – details

Some data is kept after a given purpose has been fulfilled so that I can prove certain facts in the future, for example that you gave consent to receive e-mails, or establish, assert or defend claims. I rely in this regard on my legitimate interest (Article 6(1)(f) GDPR).

7. How long do I keep your personal data?

I keep your data for the following periods:

newsletter and price alerts – until you unsubscribe or withdraw your consent; after that, only the information needed to prove consent and its withdrawal, until the expiry of the limitation period for possible claims,

correspondence – for as long as needed to handle the matter and then for archive purposes, until the expiry of the limitation period for possible claims,

Google Analytics – for the data retention period set in my Google Analytics account,

Jetpack statistics logs – according to Automattic, logs containing IP addresses are kept for 28 days,

cookie consent choice – for the lifetime of the consent cookie stored in your browser.

8. Who are the recipients of your personal data?

I use services provided by third parties. Some of these services involve the processing of your personal data. These providers are:

OVH SAS, 2 rue Kellermann, 59100 Roubaix, France (OVHcloud) – hosting provider, whose servers in the European Union store the website and its data,

MailerLite – provider of the mailing system used for the newsletter and price alerts,

Google – provider of Google Workspace (e-mail handling for contact@metalsradar.com) and Google Analytics with Google Tag Manager; for users in the European Economic Area the service provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland,

Automattic Inc., 60 29th Street #343, San Francisco, CA 94110, USA – provider of Jetpack (website statistics and security features).

These providers process your data on the basis of data processing agreements and guarantee an adequate level of personal data protection.

If the need arises, your data may be made available to a legal adviser bound by professional secrecy, if legal assistance requires access to your data.

In addition, if necessary, your personal data may be shared with authorities or institutions entitled to access the data under the law, such as the police, courts or prosecutors.

Dealers whose websites you visit through “Go to shop” links do not receive any personal data from me. Once you are on a dealer’s website, the dealer processes your data as an independent controller under its own privacy policy.

9. Do I transfer your data outside the European Economic Area?

Yes, some processing operations may involve the transfer of your data outside the European Economic Area (EEA), in particular to the United States of America (USA). This happens when the following providers or their affiliates process data:

Google LLC (USA), within Google Analytics and Google Workspace – Google LLC has certified its adherence to the EU-U.S. Data Privacy Framework and also relies on standard contractual clauses where required,

Automattic Inc. (USA), within Jetpack – Automattic uses standard contractual clauses approved by the European Commission,

MailerLite – subscriber data is stored in data centres in the European Union; where data is processed by MailerLite, Inc. in the USA, MailerLite relies on the EU-U.S. Data Privacy Framework, and its sub-processors outside the EEA are bound by standard contractual clauses.

My hosting provider, OVH SAS, stores the website data on servers in the European Union.

10. Do I use profiling or automated decision-making?

I do not make decisions about you based solely on automated processing, including profiling, that would produce legal effects concerning you or similarly significantly affect you.

I do not use remarketing or behavioural advertising on this website.

11. What rights do you have in relation to your personal data?

The GDPR grants you the following rights related to the processing of your personal data:

the right to access your data and to receive a copy of it,

the right to rectify (amend) your data,

the right to erasure (if, in your opinion, there are no grounds for your data to be processed, you can demand that your data be erased),

the right to restrict processing (you can demand that I restrict processing only to storing your data or performing actions agreed with you, if in your opinion I have inaccurate data or I am processing it without grounds),

the right to object to processing (you have the right to object to processing based on legitimate interests; you should indicate the particular situation that you think justifies the cessation of processing; I will stop processing your data for these purposes unless I demonstrate that the grounds for processing override your rights or that your data are necessary for me to establish, assert or defend claims),

the right to data portability (you have the right to receive, in a structured, commonly used, machine-readable format, the personal data you have provided on the basis of your consent; you can have this data sent directly to another entity),

the right to withdraw your consent at any time, if you have given it,

the right to lodge a complaint with a supervisory authority (if you find that I am processing your data unlawfully, you may lodge a complaint with the President of the Personal Data Protection Office (UODO) in Poland or another competent supervisory authority).

The rules for exercising these rights are described in Articles 15 – 22 of the GDPR. The rights indicated above are not absolute and may not apply to all processing activities.

You can always request information about what data I hold about you and for what purposes I process it. Just send an email to contact@metalsradar.com.

12. Do I use cookies and what are they?

My website, like almost all other websites, uses cookies.

Cookies are small pieces of text information stored on your device (e.g. computer, tablet, smartphone), which can be read by my website (own cookies) or by third-party systems (third-party cookies). Cookies may record and store certain information, which can then be accessed for specific purposes.

Some cookies are deleted when the browser session ends, i.e. when you close the browser (session cookies). Other cookies are kept on your device and allow your browser to be recognised the next time you visit the website (persistent cookies).

13. On what basis do I use cookies?

I use cookies on the basis of your consent, except for cookies that are strictly necessary for the website to work.

Cookies that are not necessary remain blocked until you consent to them. During your first visit to the website, I display a cookie banner (provided by the Complianz plugin) asking for your consent, with the option to decide which categories of cookies you accept and which you want to block. You can change your choice at any time in the cookie settings available on the website.

Please note that disabling or restricting cookies may prevent you from using some of the features of the website.

14. Can you disable cookies?

Yes, you can manage cookies in your web browser. You can block all or selected cookies, block cookies of specific websites and delete previously saved cookies and other site data at any time.

Web browsers also offer incognito (private) mode. Cookies created in this mode are deleted when you close all windows in this mode.

There are also browser extensions to control cookies, such as Ghostery. Cookie control may also be provided by other software, in particular antivirus packages.

You can also control cookies directly on my website, using the cookie settings that allow you to block the cookies you do not want.

Please note that disabling or restricting cookies may prevent you from using some of the features of the website.

15. For what purposes do I use my own cookies?

Own cookies are used to ensure the proper functioning of the website, such as the proper submission of the newsletter and price alert forms.

Own cookies also store your cookie consent choice made in the cookie banner, so that the banner is not shown again on every page.

16. What third-party cookies are used?

The following third-party tools that may use cookies operate on the website:

Google Analytics (loaded through Google Tag Manager),

Jetpack.

Google Analytics – details

I use Google Analytics, provided for users in the European Economic Area by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland (affiliated with Google LLC, USA). The tool is loaded through Google Tag Manager and works only if you consent to analytics cookies.

Google Analytics automatically collects information about your use of the website and stores it on Google’s servers, which may be located around the world, including in the USA. According to Google, in Google Analytics 4 IP addresses are not logged or stored.

I emphasise that within Google Analytics I only have access to Anonymous Information and aggregated reports.

Apart from withdrawing your consent in the cookie settings, you can block Google Analytics by installing the browser add-on provided by Google: https://tools.google.com/dlpage/gaoptout.

If you are interested in details of how Google uses data from websites that use its services, please read: https://policies.google.com/technologies/partner-sites.

Jetpack – details

I use Jetpack, a WordPress plugin provided by Automattic Inc., 60 29th Street #343, San Francisco, CA 94110, USA, for website statistics and security features.
